STAY BETTER VACATIONS TERMS & CONDITIONS
Please read the Terms & Conditions and Rental Agreement thoroughly. Your signature, payment of money, or taking possession of the property after receipt of this agreement, is evidence of your acceptance of the agreement and your intent to use the property in accordance to the following vacation rental guidelines. Please take a few minutes to make certain that you understand what we provide and what is expected of you, our tenant, and that of your guest(s).
ACCOMMODATIONS
Each property is individually owned, furnished, and decorated according to each Owner’s tastes. Specialty items will vary. All properties come standard with linens for all beds and towels for bathrooms at no additional charge. For your convenience, you will find in your rental a starter supply of paper towels, toilet paper, laundry detergent, dish soap and detergent, trash bags, and enough coffee (pods or ground), creamer, and sugar to get you started. You will be responsible for additional supplies during your stay.
STANDARD AMENITIES
All rental properties include washer/dryer, dishwasher, microwave, and either cable or streaming TV. Our rental properties also provide high-speed WiFi Internet access. Property specific amenities vary and will be provided on the property pages online. If you are staying in one of our properties at Omni Amelia Island Plantation, please be aware that certain amenities at the resort are not available to our guests. Please ask if you have specific questions regarding the amenities.
TERMS OF PAYMENT
Preferred payment is by Visa, MasterCard, Discover, or American Express. For reservations made more than thirty 30 days before arrival date, an initial deposit of 10% is required at the time of booking. The balance of the rental payment is due 30 days prior to arrival date and is automatically deducted from the credit you used when booking. For reservations made less than 30 days before arrival date, the full amount is due at the time of making the reservation. At the time of reservation, you will receive an email confirmation with additional details on your rental.
Should you choose to use a different credit card for your second automated payment, please advise us before the auto payment is processed to avoid a 4% credit card processing fee to adjust the payment method. If your credit card is denied for any payments due, a 4% credit card fee will be added to your booking to cover the cost of processing payment a second time.
CREDIT CARD AUTHORIZATIONS
Your signature on the Rental Agreement confirms authorization for Stay Better Vacations to debit your credit card account (Visa, MasterCard, Discover or American Express) for the initial deposit, balance of rental charges due upon arrival and/or to reimburse Stay Better Vacations for costs incurred to repair/replace damaged or lost items. Charges to the credit card may include, but are not limited to: damages over and above normal wear and tear, theft, smoking violation, phone charges, excessive clean up, excessive trash, unauthorized pets, unreturned keys, unauthorized early check in or late check out, and/or exceeding occupancy limits. If a fee is required, we will notify you to explain the reason for the additional credit card charges.
OCCUPANCY
In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval. No fraternities, school, civic, or other non-family groups are permitted unless granted prior approval. In no event shall guests assign or sublet the Rental Property in whole or in part. Guest agrees that they will be present during entire rental period.
You must be at least 25 years old to rent any of our rentals.
Any reservations made under false pretenses will result in the loss of advance payments and possible removal of guest(s) from rental unit. Our occupancy limits are determined by local laws and must be adhered. In the description of each property, the maximum number of people the property will accommodate is stated (excluding children under 2 years of age). Any violation of the {PMAXGUESTS} maximum occupancy may be grounds for immediate eviction and subject to an additional fee.
CHECK-IN
Check-in time is 4:00 p.m. (Eastern Time).
CHECK-OUT
Check-out time is 10:00 a.m. (Eastern Time). On the day of departure, check-out time is 10a. Should any renter stay beyond this time, without prior approval by SBV staff, a late-fee of $50 will be applied to the credit card on file for every 30 minutes beyond 10a.
CANCELLATION POLICY
There will be no refunds for no-shows, late arrivals, early departures, inclement weather (i.e. hurricanes, tropical storms, tropical depressions, etc.), or for leaving the home for mechanical failure of non-essential items. We strongly encourage all guests to purchase travel insurance. Our hurricane season runs from June 1st through November 30th.
Changes to dates or rental location is allowed within 48 hours after original booking/confirmation is complete, but ONLY if your arrival date is more than 30 days away. Cancellation requests received within 24 hours of booking are permitted, but will incur a 3% credit card fee to cover the processing for both transactions (booking & refund).
CLEANING
Daily maid service is not included in the rental. All rentals will include a mandatory cleaning fee upon departure, which prepares the property for the next rental. You may be charged an additional amount if additional cleaning is required above and beyond normal guest usage. Also, please make sure all property items (keys, remotes, pool key cards, towels, etc.) are left in the unit or you will be charged an replacement fee.
COMMUNICATION
In addition to confirming your reservation via email, we will also send 2 to 3 text messages with additional details pertaining to your reservation with Stay Better Vacations. If you do not want to receive any updates via text, to include emergency notifications from Stay Better Vacations, please notify us by sending an email to [email protected]. It is your responsibility to ensure we have your correct cell number and email address.
DAMAGES
Guest assumes full responsibility for any items damaged due to misuse or negligence or action on guest’s part, except in the case of normal wear-and tear. Guest is responsible for notifying Stay Better Vacations 2 hours after check-in if the Rental Property is found in less than desirable condition or any damage is noted. If damages occur during your stay, please notify us. If damage is found following departure, we will advise of charges to be processed. We inventory all towels and linens after departure. Missing or damaged towels will result in charges to the credit card on file or an invoice will be provided.
Should your rental provide a plastic parking tag (not paper), pool key fob, pool key card, tennis key, bathroom key, or gate or garage door opener, there is a $50 replacement fee if lost.
DISTURBANCES
You and your guest(s) will be required to vacate the premises and forfeit the rental fee for any of the following reasons: A) Using the premises for any illegal activity including, alcoholic beverages by or to persons less than 21 years of age. B) Causing damage to premises rented or to any of the neighbor’s properties. C) Any other acts which interfere with the neighbors’ right to quiet enjoyment of their property.
CONSTRUCTION
Construction or renovation work may take place at different times of the year in the vicinity of where you are staying. Depending on the work, we are sometimes given advance notice and will pass this information along to our guests. We will do our best to notify you in advance if your stay may be impacted. In some cases, we are not given advance notice of scheduled work, or unexpected work may take place. If your rental property is near construction activity, please be understanding. No refunds or moves can be guaranteed.
MAINTENANCE/REPAIRS/REFUNDS
All equipment in each property should be in working order. Please report any inoperable equipment to our office promptly. We will make every reasonable effort to have the problem corrected as soon as possible. Cable and internet outages will be addressed as soon as possible. If it is after 6p, we will correct the issue the next morning. Reasonable wear and tear is the responsibility of the property owner. While rare, all pools/hot tubs are subject to temporary closings due to extenuating circumstances. No refunds or rent reduction can be guaranteed if this occurs. We cannot guarantee against mechanical failure of heating, air conditioning, TVs, or other appliances. No refunds or rent reductions can be guaranteed due to failure of appliances or equipment. No refunds for early departures or delayed arrivals. There are no refunds because of tenant dissatisfaction with unit’s décor, any equipment malfunction or for errors in advertisement of property.
PETS
Only our pet friendly rentals, which will be noted on the listing, allow dogs. There is a non-refundable pet fee for our pet-friendly properties. The pet fee will be paid at the time of booking through our website; or if you are booking via another website you will receive a separate request to submit payment. Guests with dogs are asked to please respect the comfort and safety of other guests, both during and after your stay. For this reason, we ask that you please follow these guidelines during your time with us:
Please clean up after your dog.
Please do not allow dogs on furniture or beds.
Please don’t leave your dog unattended for long periods of time.
You are responsible for any damages your pet causes.
Please do not allow dogs in swimming pools or on tennis courts.
Extra cleaning fees will be charged for furniture, blankets, comforters, etc. that have pet hair left behind.
Pets need to be on a leash at all times; it is not only an Association rule but a Fernandina Beach City Ordinance and applies to dogs on beaches as well
If a guest is found to have brought a pet without prior approval, additional fees will be administered, and guests may be required to vacate the property immediately.
PARKING
Many of our complexes have limited parking and/or assigned parking. We cannot guarantee that there are any additional spaces beyond what is provided or assigned. Please be sure you have read the description and amenities for the rental you booked. Refunds are not issued if you booked a unit that does not accommodate additional cars.
LOST AND FOUND
If you have left something behind, we are happy to return to you within 7 days after your departure. After that we will dispose or donate. Please be sure to notify us as soon as you realize the item is not with you - we'll notify our staff to look for it and if found the cost to return is $5.00 plus shipping cost via USPS or UPS, charged to the credit card we have on file or another card number you can provide. If you have an account with FedEx or USPS, we can ship through those carriers also.
We are not responsible for any items left behind.
SUBSTITUTION/NON-AVAILABILITY
We reserve the right to substitute properties. Should the home/condo you reserved become unavailable for any reason whatsoever, Stay Better Vacations will inform you when non-availability is absolutely certain. Every attempt will be made to relocate you and your guest(s) to a comparable property. If you wish to upgrade to another property, you are responsible for costs associated with the rental upgrade.
PROPERTY FOR SALE
In the event the property you are renting is on the market for sale, there may be requests to show the property during your visit. We will make every effort to schedule the showing at a convenient time and not interrupt your visit. Should the unit be conveyed to a third party prior to the date of your vacation rental, you will be notified as soon as possible and guests have the right to cancel. Otherwise, Stay Better Vacations will make every attempt to find a comparable property. When comparable accommodations are not available, guest(s) will have the option of selection from available properties or receiving a complete refund.
RIGHT OF ENTRY
Our staff, the owner(s), and/or our representatives have the right to enter premises during tenancy to inspect, and to make necessary property repairs. We will notify guests if any entry is needed and will give proper notice. Pest control, unscheduled maintenance, inspections, and repairs may be necessary during your stay. If SBV is aware of these events, we will alert you. On occasion, these visits will be unknown to us due to the building HOA or Owner scheduling without our knowledge.
SMOKING
You and your guest(s) understand that smoking is prohibited inside all of our rental properties. Smoking on the premises will result in an additional cleaning fee. Please note that Ketch Courtyard and The Pelicans are non-smoking complexes; no smoking of any kind is permitted on the ground, which includes the balcony. Failure to adhere to these policies will result in fines or eviction from complex/rental.
LISTINGS and PRICING
Information regarding individual listings is believed to be accurate but cannot be guaranteed. We have made every effort to ensure all the information we provide via print or online is current and accurate. Rates, furnishings, fees, and taxes are subject to change without notice.
ERRORS & OMISSIONS
Every effort has been made to ensure the accuracy of all information provided. Stay Better Vacations will not be responsible for errors in information and reserves the right to make any necessary changes.
PRIVACY POLICY
Stay Better Vacations considers your privacy a serious matter. We safeguard all data and do not distribute any information to third parties.
ASSUMPTION OR RISK, RELEASE & INDEMNIFICATION
The signer and his/her guests agree to assume all risk for injury, death, or damage to persons or property in any way arising from this rental. Further, said parties hereby release Stay Better Vacations, LLC., its employees and representatives, and the Homeowner from any and all liability for such injuries and/or damages in any way arising out of their use of the premises and related facilities and agree to indemnify and hold them harmless from any claims, demands, losses or causes of action arising out of said use. Signer and his/her guests also agree to be responsible for any and all damage to the property owned or leased by Stay Better Vacations, LLC., which in any way arises out of the use of the premises and related facilities by said parties.
OUTDOOR ACTIVITIES
The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming. Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons. |
